Nevada statutes on public notices

The definition of a newspaper qualified to publish public notices is contained in NRS 238.

Here’s the basic definition:

NRS 238.030 Publication of legal notice or advertisement only in qualified newspaper of general circulation; exceptions.

public notice copy      1.  Any and all legal notices or advertisements shall be published only in a daily, a triweekly, a semiweekly, a semimonthly, or a weekly newspaper of general circulation and printed in whole or in part in the county in which the notice or advertisement is required to be published, which newspaper if published:

      (a) Triweekly, semiweekly, semimonthly, or weekly, shall have been so published in the county, continuously and uninterruptedly, during the period of at least 104 consecutive weeks next prior to the first issue thereof containing any such notice or advertisement.

      (b) Daily, shall have been so published in the county, uninterruptedly and continuously, during the period of at least 1 year next prior to the first issue thereof containing any such notice or advertisement. …

      4.  If in any county in this State there shall not have been published therein any newspaper or newspapers for the prescribed period, at the time when any such notice or advertisement is required to be published, then such notice or advertisement may be published in any newspaper or newspapers having a general circulation and printed and published in whole or in part in the county.

    NRS 238.040  Second-class mailing permit required for qualification.  After December 31, 1954, no newspaper is competent as the means for the publication of any legal notice or advertisement unless the newspaper possesses and maintains in force a valid second-class mailing permit issued by the United States Postal Service.

Legal notice statutes are listed in numerical order according to their NRS or Nevada Revised Statute number. They are also listed under subject headings.

SUMMONS FOR CIVIL LAWSUIT

Nevada Rules of Civil Procedure, Rule 4 (Process)–Notice of summons and civil suit, including a divorce, against a defendant when the defendant resides out of state, has departed from the state, or cannot, after due diligence, be found within the state or conceals himself to avoid being served. The complaint and summons in such cases can be served on the defendant by publication in a newspaper for a period of 4 weeks, at least once a week during that time.

NOTICE TO SELL PROPERTY TO ENFORCE A JUDGMENT

21.130–Notice of the sale of property–personal and real–to satisfy an unpaid debt or a court judgment.

A sheriff’s sale of personal property to enforce a District Court judgment must be published in a newspaper in the county, if there is one, at least twice, the first publication being not less than 10 days before the date of the sale.

In the case of real property (real estate), a notice of the foreclosure sale (commonly a trustee’s sale) must be published 3 times, once each week, for three consecutive weeks, in a newspaper if there is one in the county.

MISC. NOTICES TO SELL PROPERTY

37.260–Notice of the sale of property acquired through eminent domain. The notice of the sale must be published in a newspaper of general circulation in the county where the property is located at least once and appear not less than 15 nor more than 45 days before the sale.

39.270–Notice of a public auction or private sale of property from an estate. The notice must be published once each week for 3 consecutive weeks in a newspaper of general circulation in the county.

NAME CHANGE

41.280–Notice that a person has filed a court petition to change his/her name. Notice must be published in a newspaper of general circulation in the county once a week for 3 successive weeks.

PRIVATE CORPORATIONS

78.275–Notice of a private corporation’s intention to levy and collect assessments on corporation stock. Notice of the assessment may be given to stockholders personally or by publication once a week for at least 4 weeks in a newspaper in the county where the corporation is located.

FOREIGN CORPORATIONS

80.190–Publication of an annual statement by a foreign corporation doing business in Nevada. The statement must be published in two numbers or issues of a newspaper published in the state no later than the end of the third month following the close of each fiscal year. The punishment for failing to publish the statement is $100 for each month the statement remains unpublished.

LIENS

(Note: There are a number of state laws requiring the publication of notices regarding liens and the sale of property to cover a lien or unpaid bill. This list does not include all of the laws. The following are provided as examples.)

104.7210–Notice of a sale to enforce a warehouseman’s lien. Notice must be published once a week for 2 consecutive weeks in a newspaper of general circulation where the sale will be held.

107.080–Notice of default and trustee’s sale of real property (real estate) in a foreclosure action.   The notice must be published in a newspaper in the county, if there is one, at least twice, the first publication being not less than 10 days before the date of the sale.

108.239–Notice to enforce a lien through a court complaint. Notice must be published at least once a week for 3 successive weeks in one newspaper published in the county.

108.310–Notice of a public sale of a motor vehicle to satisfy a lien. Must be printed once a week for 3 consecutive weeks in a newspaper published in the town or county where the sale is to be held.

108.450–Notice to sell property placed in storage to satisfy unpaid storage charges. Notice must be published once a week for 2 consecutive weeks in a newspaper of general circulation in the town or county where the owner resides.

UNCLAIMED PROPERTY

120A.280–Notice of names of persons appearing to be owners of abandoned property. The notice must be entitled “Notice of Names of Persons Appearing To Be Owners of Abandoned Property” and be published in at least one newspaper of general circulation in the county in which the last known address of any person named in the notice is located.  120A.360–Notice concerning the sale or destruction of abandoned property. The notice must be published once at least 2 weeks prior to the sale in a newspaper of general circulation in the county where the property is to be sold.

TERMINATION OF PARENTAL RIGHTS

128.070–Notice of a court hearing on a petition to terminate parental rights. The court may require the publication of such a notice if the father or mother or the child’s legal guardian resides out of state, cannot be found within the state or conceals himself/herself. The notice must be published in a newspaper–to be designated by the court–at least once a week for 4 weeks.

SALE OF PROPERTY FROM AN ESTATE

148.190 and 148.220–Notice concerning the sale of property (in excess of $5,000) from an estate (under certain circumstances).   The notice must printed three times over a two week period in a newspaper published in the county where the sale is to take place.

ESTATES, GUARDIANSHIPS AND TRUSTS

155.020–Notice of a hearing on a petition to probate a will (administer an estate) and notice to creditors. Notice must be published three times. If the newspaper is published more than once each week, there must be at least 10 days from the first to last dates of publication. Notice must be published in a newspaper printed in the county where the hearing will be held, but if there is no such newspaper, then in one having general circulation in the county.

156.020 — Requires the publication of a notice of a hearing on a petition to appoint a trustee for the estate of a missing person.  The notice must be printed at least 10 days prior to the hearing in a daily or weekly newspaper published in the county in which the presiding court and last known residence of the missing person are located.

PLANNING AND ZONING

270.040–Notice of the filing of maps or plats with city clerk. Must be published at least once a week for 4 successive weeks.

270.160–Publication of an application to vacate portion of platted land within a city. Application must be published at least once a week for 3 successive weeks. Applicant must pay for the cost of publication.

277.050–Notice of a public hearing on a public agency’s intention to sell, exchange or lease real property to another public agency. Must be published not less than twice, on successive days, the last publication to be not less than 7 days before the date of the hearing.

278.210–Notice of a public hearing before planning commission on adopting or amending a master plan. Must be published once at least 10 days before the hearing.

278.220–Notice of public hearing before governing body (such as a city council or county commission) on the adoption of a master plan. Must be published once at least 10 days before the day of hearing.

278.260–Notice of public hearing on zoning regulations, boundaries or enforcement. Must be published once at least 10 days before the hearing.

278.480–Notice of a public hearing on a city or county’s petition to vacate or abandon any street or easement the city or county owns. Must be published at least once not less than 10 nor more than 40 days before the hearing.

ELECTIONS

293.130–Notice of a county convention of each major political party. Notice of the party’s county convention must be published in one or more newspapers, if any, published in the county.

293.135–Notice of precinct meeting of registered voters before political party’s county convention. The county central committee of each major political party in each county must publish a notice of a precinct meeting of the registered voters. The notice must be published at least five days before the meeting in one or more newspapers of general circulation in the precinct, published in the county, if any are so published.

293.203–Notice of primary election. County clerk shall publish notice of the primary election in a newspaper of general circulation in the county once a week for 2 successive weeks.

293.253–Publication of constitutional amendments and statewide measures. Each county clerk shall cause to be published a copy of the full text of any such constitution, amendment or measure and its condensation explanation, including arguments for and against it, and fiscal note in conspicuous display advertising format of not less than 10 column inches in a newspaper of general circulation in the county. Publication must be made three times at intervals of not less than 7 days, the first publication to be on or before the first Monday in October. If no such newspaper of general circulation is published in the county, then the publication may be made in a newspaper published in the nearest Nevada county.

293.557–Publication of list of registered voters. County clerk is to publish once in each of the newspapers circulated in different parts of the county or once in a newspaper circulated in the county a list of registered voters OR a notice that such a list is available free of charge at the county’s clerk’s office. (Notice: the clerk has a choice of publishing the list or the notice that the list is available.) If the clerk chooses to publish the list, the list must be published not less than 2 weeks before the close of registration for any primary election. It also must be published after each primary election and not less than 2 weeks before the close of registration for the ensuing general election. The county may not pay more than 10 cents per name for six-point or seven-point type or 15 cents per name for eight-point type or larger to each newspaper publishing the list. The list, if published, must not be printed in type smaller than six-point.

293.560–Notice of close of voter registration. County clerk shall publish a notice indicating the day registration for voting will be closed. Notice must be published in a newspaper having a general circulation in the county, and if such a newspaper is not available, then publication may be made in a newspaper in the nearest county.

PURCHASING – LOCAL GOVERNMENT

332.035, 332.036, 332.039 and 332.045–Publication of notice to bid. Governing body must publish notice on formal bids for contracts at least once and not less than 7 days before the opening of bids. Bid advertisement must be published in a newspaper published and having general circulation within the county where the local government is situated. If no such newspaper is published in the county, then publication must be in any newspaper published in the state that has general circulation in the county. The notice must state the nature of the contract,  where plans and specifications may be seen (if applicable), the time and place where bids will be received and opened and other matters that may pertain to the bid.  All local government bodies in Clark and Washoe counties must advertise a notice to bid for contracts exceeding $25,000.  All governing bodies in other counties that have at least $1 million in annual expenditures must advertise a notice to bid for contracts exceeding $25,000. For purchases between $10,000-$25,000, those governing bodies must publish a notice that sets forth the date on which the contract may be awarded, the estimated amount, the general purpose of the contract and information on how a contractor can get his name on the governing body’s list of contractors.

PURCHASING–STATE GOVERNMENT

333.220 – Chief of the state Purchasing Division must publish a notice to sell condemned (or excess) property with an appraised value of more than $1,000.  The notice must be published at least once within 15 days before the sale in a newspaper circulated in the area of the sale.

333.310–Advertisement of bids for state purchasing contracts when the estimated cost exceeds $25,000. Purchasing contracts must be advertised in at least one newspaper of general circulation in the state.

PUBLIC WORKS PROJECTS

338.143–Advertisement of  bids for any state or local government contract for the construction, alteration or repair of a public work when the estimated cost exceeds $100,000. Advertisement must be placed in a newspaper of general circulation in the state.

340.070–Notice of a court hearing on a petition to condemn property for a public works project. Notice must be published in a newspaper in each county in which any part of the property is located.

341.148–Advertisement for bids for each state construction project authorized by the state Public Works Board if the estimated cost of the project is $25,000 or more.

Advertisement must be placed in a newspaper of general circulation in the state.

BOND ELECTIONS

349.013–Notice of a bond election by the state. The clerk of each county must publish the notice in some newspaper printed in the county once each week for 2 successive weeks.  The first publication date must not be more than 30 nor less than 22 days prior to the election.

350.022–Notice of a bond election by a municipality (local government). Notice must be published in a newspaper having a general circulation in the municipality once a week for 2 successive weeks not more than 30 days nor less than 22 days preceding the election. If no newspaper is printed in the municipality, the notice must be published in a newspaper having general circulation in the municipality.

LOCAL GOVERNMENT FINANCES

354.210–Notice of list of bills allowed by the county commission. The bills, together with the names of the people for whom such allowances are made and for what such allowances are made, must be published quarterly on the county’s web site. A notice of the list must be published five times in a newspaper in the county. The amount paid for the notice shall not exceed the statutory rate for publication of legal notices. The notice shall not extend beyond a single insertion. (An attorney general’s opinion says the list must be published quarterly as required by NRS 244.225 and with the detail required by NRS 354.210.)

354.596–Notice of public hearing on the tentative budget of a local government (city, county, school boards, etc.). Must be published once in a general circulation newspaper not more than 14 nor less than 7 days before the date of the hearing.

354.615–Notice of local government’s intention to augment its budget. Must be published at least once in a newspaper of general circulation in the county.

PROPERTY TAXES

360.540–Notice of sale of property seized to pay sales or use taxes. Must be published at least 10 days before the sale in a newspaper in the county where the sale will occur.

361.300–Optional newspaper publication of the list of taxpayers and the valuations of property for which taxes are owed. County assessor has the option of having the tax list published in a newspaper, mailing the list to each taxpayer or publishing it on the county’s website. A notice that the county’s tax roll is completed and open to inspection must be published in a newspaper before Jan. 1.

361.335–Notice of meeting of County Board of Equalization for equalizing property tax assessments. The notice must be published in a newspaper in the county, if there is one.

361.340–Notice of the County Board of Equalization meeting schedule (dates, times and places).  The notice must be published at least 5 days before the first meeting in a general circulation newspaper printed in the county.

361.350–Publication of a list of property owners whose assessments were increased by the County Board of Equalization and who did not appear before the board. The list must be published once in a newspaper in the county.

361.4545–Informational notice regarding public hearings on tax rates and tentative budgets by counties and political divisions within the counties. The notice stating public hearings will be held on the tentative budget and the budget will be adopt on July 1 must be published on or before May 5 of each year.  A notice of assessed property value , must be printed within 10 days of receiving the information and displayed in the format used for advertisements and printed in not less than 8-point type on at least one quarter of a page in the newspaper. In addition, a notice disclosing any property-tax increase as a result of the tentative budget must be published within 10 days of receiving it and it must be displayed in the format used for news and printed in not less than 8-point type.

361.480–Notice of property tax bills. The notice of when taxes are due and the penalties for delinquency must be published at least quarterly in some newspaper published in the county.

361.535–Notice of seizure of mobile home or house trailer to satisfy unpaid property taxes. Must be published once during 2 successive weeks in a general circulation newspaper in the county.

361.565–Notice of delinquent taxpayers. Counties must publish the list of delinquent taxpayers at least once in a newspaper if taxes remain delinquent 30 days after the first Monday in April. The list must contain the name of the owner, if known, the description of the property, the amount of taxes due and the penalty. Cost of publication must be charged to the delinquent taxpayers.

361.595–Notice of sale of property for delinquent property taxes. Notice must be posted OR published in a newspaper for 20 days.

HISTORICAL DISTRICTS

384.005–Notice of a public hearing on the proposed establishment of a historic district by a county or city government. Must be published once a week for 3 consecutive weeks.

EDUCATION

386.270–Notice of public meeting on an appointment to fill a vacancy on a school board. Must be published at least once each week for 2 weeks.

387.320–Quarterly publication of a list of expenditures of a school district. Must be published each quarter of each school year.

393.080–Notice of a school board meeting to change the location of a school, close a school or change the use of a school building. Must be published at least 10 days before the meeting.

393.260–Notice of a school board meeting to consider bids for the lease or sale of any real property owned by the school district.  The notice must be published at least once a week for 2 successive weeks in a general circulation newspaper in the county prior to the meeting.

393.3291–Notice of a school board meeting on a proposed exchange of real property. Must be published once a week for 2 successive weeks before the meeting.

ROADS AND HIGHWAYS

403.170–Notice of a public hearing on any designation of a county road, reclassification of any road or abandonment of any county road.  The notice of the time and place of the hearing must be published at least 10 days prior to the hearing.

405.195–Notice of a public hearing before a county commission on a petition by residents to open, reopen, close, relocate or abandon a public road within the county. Must be published once each week for 2 successive weeks.

405.203–Notice of a public hearing before a county commission on the permanent closure of any accessory road when public safety or welfare so requires, such as the danger of fire. Must be published for 3 successive weeks before the date of the hearing.

408.327–Advertisement for bids for construction, maintenance or improvement of state highways. The ad must be made at least once a week for 2 consecutive weeks for a total of at least two publications in a newspaper of general circulation in the county in which the major portion of the construction is to be made; and the ad must also be published at least once a week for 2 consecutive weeks for a total of at least two publications in one or more daily papers of general circulation in the state.

408.367–Advertisements for informal highway construction bids for a project not exceeding $250,000. Must be published once in any newspaper or publication.

408.387–Notice of final acceptance of state highway construction contract. Must be published before state makes final payment on any contract. Must be published at least 2 weeks in every issue of a newspaper of general circulation in the county wherein the major portion of the contract work was performed, and such notice may also be published each day for a period of at least 10 days in one or more daily newspapers throughout the state.

ENVIRONMENTAL QUALITY; AIR POLLUTION

445A.435 — Notice of a State Environmental Commission hearing on a regulation that provides a standard of water quality or waste discharge. Must be published at least once in a newspaper of general circulation in the area to which the standard, if approved, will apply.

445B.215 — Notice of public hearing on a regulation to be considered by the State Environmental Commission. Must be published at least 3 times in newspapers throughout the state, once a week for 3 weeks, beginning at least 30 days before the hearing.

DEAD BODIES

451.110–Notice of intention to remove the human remains from all or any part of any cemetery. Must be published once a week for 2 successive months.

GAMING

463.145–Notice of a state Gaming Commission meeting in which the commission proposes to adopt, amend or repeal any commission regulations. At least 30 days before the initial meeting of the commission and 20 days before any subsequent meeting at which the proposed regulation change is considered a notice must be published in “such newspaper as the commission prescribes…”

463.152–Notice of person placed on gaming regulators’ “black book” of people excluded or ejected from licensed gaming establishments. Notice must be published daily for 1 week in one of the principal newspapers in Reno and in one of the principal newspapers in Las Vegas.

463B.240–Notice of the sale of a gaming establishment. Must be published in a newspaper of general circulation in the county in which the establishment is located.

HUNTING

501.118–Notice of proposed official orders or regulations of Board of Wildlife Commissioners regarding open or closed hunting seasons, bag limits or hours. Whenever the commission is required to publish such an order or regulation, it shall be published once in each case in a newspaper of general circulation in the state or in the locality to which the order applies.

WATER APPROPRIATION

533.095–Notice of order regarding claimants’ rights to waters of a stream system. State engineer must publish the notice for 4 consecutive weeks in one or more newspapers of general circulation within the boundaries of the stream system.

533.110–Notice setting forth the date when the state engineer is to commence the taking of proofs as the rights in and to the waters of the stream system. Must be published for a period of 4 consecutive weeks in one or more newspapers within the boundaries of the stream system, the date of the last publication must not be less than 15 days prior to the date fixed for the taking of proofs.

533.165–Notice of court hearing on state engineer’s order determining water rights in a stream system. Must be published at least once a week for 4 consecutive weeks in some newspaper of general circulation in each county where the stream system is located.

533.360–Notice of an application for a permit to appropriate or divert public water. State engineer must publish notice for a period of 4 consecutive weeks in a newspaper published in the county where the water is located. State engineer says the fee for publication is $50, as outlined in his fee schedule (see NRS 533.435). However, that law says how much the engineer can charge applicants for the cost of publication. The law does not specifically say what the newspaper can charge, although the state engineer has determined a newspaper cannot charge more than $50 for the notice.

534.270–Notice of an applicant for a permit to operate an underground water storage project, such as a well. Must be published once each week for 2 consecutive weeks in a newspaper in the county or counties affected by the project.

IRRIGATION DISTRICTS

539.030–Notice of meeting in which a county commission will hear a petition calling for the creation of an irrigation district. Must be published for at least 2 weeks before the date of the meeting in some newspaper printed and published in the county where the petition is presented.

539.047–Notice of an election on whether to form an irrigation district. Must be published for 2 weeks prior to the election in a newspaper within the county where the petition is filed.

539.125–Notice of an election by an irrigation district (for officers and proposals). Must be published once in a newspaper in the county or one of the counties in which the district is located and must appear not less than 15 days nor more than 22 days before the election.  If no such newspaper exists, then the notice must be published in a newspaper of general circulation in the county.

539.485–Publication of irrigation district’s monthly list of claims (bills). Must be published one time for claims allowed the preceding month in a general circulation newspaper in the county.

539.487–Publication of irrigation district’s annual financial statement. Must be published on or before the 1st Tuesday of September of each year in at least one issue of some newspaper published in the county where the district office is located.

539.547–Notice of irrigation district election to raise money, primarily through a bond issue, for acquiring property and construction. Must be published for 3 weeks in some newspaper published in the county where the district was organized.

539.563–Notice of an irrigation district meeting to apportion or distribute the benefits, such as construction projects, that will be financed by a bond issue that’s been approved. Must be published for 2 weeks in some newspaper published in the county.

539.610–Notice of an irrigation district’s redemption of bonds before maturity. Must be published at least 3 weeks in some newspaper published in the county where the district office is located.

WATER CONSERVANCY DISTRICTS

541.180–Notice of a municipality’s petition for an allotment of water from a water conservancy district. Must be published once each week for 2 successive weeks in a newspaper in the county where the municipality is located.

541.220–Notice of water conservancy district board meeting to hear objections to assessments. Must be published in two issues a week apart in some general circulation newspaper published in each county; but if there is any county in the district in which there is no newspaper published, then such notice must be published in an adjoining county.

541.350–Publication of a water conservancy district’s resolution to go into debt to finance improvements in an emergency situation. Must be published once a week for 2 consecutive weeks in a general circulation newspaper printed and published within the district.  The last publication must be at least 10 days prior to the election.

FLOOD CONTROL

543.690–Notice of proposed bond issue for flood control by a flood-control district or county commission. At least 60 days prior to any general obligation bonds for a term of more than 10 years are issued notice must be published in a general circulation newspaper within the district.  During the first 3 weeks of the 60 days, the notice must be published at least twice and each publication must be at least as large as 5 inches high by 4 inches wide.

WEATHER MODIFICATION

544.180–Notice of a licensee’s intention to modify or control weather. Must be published at least once a week for 3 consecutive weeks in a newspaper of general circulation published within any county in which the operation is to be conducted and in which the affected area is located.

AGRICULTURE

561.265–Publication of all general orders, rules or regulations of the state division of agriculture. Must be published at least twice in a general circulation newspaper in the area affected by the order, rule or regulation.

562.300–Publication of all orders, rules or regulations made by the state Board of Sheep Commissioners. Must be published at least twice in some newspaper having a general circulation in the state.

565.040–Publication of regulations adopted by the state Division of Agriculture regarding a livestock brand inspection district. Must be published at least twice in some newspaper having a general circulation in the brand inspection district.

569.045–Notice from a person who plans to gather any stray (estray) horses. Must be published at least once a week for the 4 weeks preceding the gathering in a newspaper in the county where the gathering is to take place.

569.070–Notice of stray livestock when owner cannot be determined. State Division of Agriculture shall advertise any stray livestock that has been gathered when the owner cannot be found. Notice must be published once in a newspaper published at the county seat of the county where the livestock was gathered.  If there is no newspaper published at the county seat of the county, notice must be published in the newspaper published at the nearest point to that county.

584.565–Notice of a public hearing by the state Dairy Commission on a proposed stabilization and marketing plan for fluid milk or fluid cream. Notice may be through the mail or by publication in a daily newspaper for 5 successive days. If there’s no daily in the area, the notice may be published for 2 successive weeks in a weekly newspaper.

584.590–Notice of public hearing by the state Dairy Commission on an investigation of prices in a marketing area. Notice may be through the mail or by publication for 5 successive days in a daily newspaper; or 2 successive weeks in a weekly if a daily is not published in the area.

LAUNDERED SUPPLIES

600.150—Registration of names or marks of laundered supply businesses.  A person engaged in the business of supplying clean laundered garments, towels, table lines or other articles which are the property of the supplier, may adopt and use a name or other mark woven, impressed or produced on the supplied items as a mark of ownership.  The registration of the name or mark with the county clerk must published once a week for 3 successive weeks in a newspaper published in the county described on the filed registration.

FINANCIAL INSTITUTIONS

660.015–Notice of bank’s intention to discontinue a branch office. Must be published once a week for 4 consecutive weeks in a newspaper serving the community before the request to discontinue the branch is filed with the state commissioner of financial institutions.

666.015–Notice of bank merger or consolidation. Must be published once a week for 4 consecutive weeks in a newspaper published in a city, town or county in which each of the banks is located.

667.015–Notice of bank’s voluntary liquidation and closure.  The bank must publish notice once in a newspaper in the city, town or county in which the bank is located.

667.205–Publication of a report on all banks under liquidation in the state. The state commissioner of financial institutions must submit the report on Jan. 1 and July 1 of each year to the secretary of state. The secretary of state shall then publish the report one time in some newspaper published in each county in which a bank is under liquidation.

704.870–Notice of public utility’s application to construct a facility. A summary of the application must be published in newspapers in the area of the proposed facility.

Nevada Administrative Code (NAC) 703.160–Notice of application or tariff filing before the Nevada Public Service Commission. If an authorization, expansion, reduction or curtailment of services, facilities or authority, increase in rates, fares or charges, or any change in regulations is filed by application or tariff filing, a notice shall be published. If the proposal has a statewide effect, the notice shall be published at least once in six or more newspapers of general circulation in the state, no two of which are published in the same county. If the proposal affects a limited number of counties, the notice shall be published once in a newspaper of general circulation in each county affected. If there is no newspaper published in an affected county, then the notice shall be published in a newspaper in an adjoining county. The notice must be published in the appropriate newspapers not less than 3 working days before the proposal becomes effective.  For the convenience of the public the notice must also be published in a designated Sunday newspaper in Carson City; this is not to be a substitution of the other newspapers, but rather an addition to the other printings. Notice must be an ad not less than 1 column inch by 3 inches, with a border on all sides. The applicant shall pay the cost of publication.

If the hearing will have a statewide effect, the notice will be published at least once in six or more newspapers of general circulation in the state, no two of which are published in the same county. If the hearing will have an effect on a limited number of counties, the notice will be published once in a newspaper of general circulation published in each affected county. If there is no such newspaper, the notice will be published in an adjacent county.  A weekly summary of the newspaper notices will be published in the Sunday edition of a newspaper of general circulation in Carson City. The summary is not a substitute for publishing the notice as required.
